Program Name: Brilliant Fertility Program
Program Dates: 16 weeks for live calls, lifetime access to curriculum
Facilitator: Katherine Rose, Brilliant Wellness Solutions, LLC

THIS AGREEMENT (the “Agreement”), is hereby entered into by and between myself, (the “Client”) and Katherine Rose. The Client and Katherine Rose (the “Parties”) agree as follows:

1. SERVICES

Katherine Rose is in the business of providing workshop facilitation, teaching and coaching services, and the Client wishes to engage Katherine Rose to provide these services (the “Services”). The Client hereby agrees to engage Katherine Rose to provide workshop facilitation and coaching services for 16 weeks within The Brilliant Fertility Program (the “Program”) hereby made a part of this Agreement as “Scope of Work”.

2. TERM

This Agreement will commence on the effective date, as recorded below, and will continue for the duration of the program, and any additional time agreed upon. The term includes access to the course content (recorded videos, audio, resources, and community), live weekly coaching and any other updates and content developed for program participants.

3. COMPENSATION AND PAYMENT FOR SERVICES

The fees for the program have been paid as agreed to either paid in full or according to the payment plan at the time of signing this agreement.

4. REFUND POLICY

Both parties have the right to terminate this agreement and enrolment in the Brilliant Fertility Program. The client may not request a refund. According to the nature of this coaching program, refunds are not available. If for any reason the client is unsatisfied, Katherine Rose will work with them to provide a satisfactory experience. Katherine Rose is not obligated to provide any refunds of any amount paid for the Services hereunder. The client understands that this Agreement and any coaching services in progress may be terminated by Katherine Rose at any time without prior written notice to Client if needed. If Katherine Rose terminates services and enrolment for the client, a partial or full refund may be provided.

5. CONFIDENTIALITY

Everything that is said via email, in the community or in the context of the conversations between Katherine Rose in group or private discussions is kept private and confidential unless the member/client expresses that it can be shared.
We encourage all members/clients of Katherine Rose to hold information identified as confidential as that. We cannot be held responsible by clients/members who share this information with others.

6. DISCLAIMER

For Educational and Informational Purposes Only: Katherine Rose provides health information in an informational and educational manner only, with information that is general in nature and that is not specific to the client. The contents of the Brilliant Fertility Program are intended to assist the client in wellness efforts. Clients are encouraged to consult their physician regarding the applicability of any information provided in the program to you. Nothing in the program should be construed as personal advice or diagnosis, and must not be used in this manner. The information provided about conditions is general in nature. This information does not cover all possible uses, actions, precautions, side-effects, or interactions of medicines, or medical procedures. The information in the program should not be considered as complete and does not cover all diseases, ailments, physical conditions, or their treatment. The client should consult with their physician before beginning any exercise, weight loss, or health care program. This program should not be used in place of a call or visit to a competent health-care professional. The client should consult a health care professional before adopting any of the suggestions in the program or before drawing inferences from it. Any decision regarding treatment and medication for the client’s condition should be made with the advice and consultation of a qualified health care professional. If the client has, or suspect they have, a healthcare problem, they should immediately contact a qualified health care professional for treatment.
The Client acknowledges that Katherine Rose is serving as a Health Coach and that purchasing and participating in the Program does not enter the client and Katherine Rose into a physician-patient relationship.

Not Medical, Mental Health, or Religious Advice: The information provided in or through the Program is not intended to be a substitute for professional medical advice, diagnosis or treatment that can be provided by your own Medical Provider (including doctor/physician, nurse, physician’s assistant, or any other medical professional), Mental Health Provider (including psychiatrist, psychologist, therapist, counselor, or social worker), registered dietitian or licensed nutritionist, or member of the clergy. Katherine Rose is not providing health care, medical or nutritional therapy services or attempting to diagnose, treat, prevent or cure in any manner whatsoever any physical ailment, or any mental or emotional issue, disease or condition. The Client agrees and acknowledges that Katherine Rose is not providing medical advice, mental health advice, or religious advice in any way.

Accuracy: Although every effort is made to ensure the accuracy of information shared on or through the Program, the information may inadvertently contain inaccuracies or typographical errors. Every effort has been made to present the client with the most accurate, evidence-based information, but because the nature of scientific research and health and wellness is constantly evolving, Katherine Rose cannot be held responsible for the accuracy of the content within the Program.

Not Evaluated by the FDA: The information with the Programs, emails, videos, products, and/or services is not evaluated by the Food and Drug Administration and is not intended to diagnose, treat, cure, or prevent any diseases, or be considered medical advice.

Personal Responsibility / No Guarantee: Katherine Rose’s role is to support and assist the Client in reaching health and lifestyle goals, but success depends primarily on the effort, motivation, commitment and follow-through of the Client. Katherine Rose cannot and does not guarantee that the Client will attain a particular result, and the Client accepts and understands that results differ for each individual. Each individual’s health and wellness success depends on his or her unique background, dedication, desire, motivation and actions. As with any healthy lifestyle or fitness-related program, product or service, results may vary, and will be based on many variables, including but not limited to, your physical body, body chemistry, stage of life, unique health and genetic profile, starting point, and level of commitment.

Assumption of Risk: There could be unknown individual risks and circumstances that could arise during use of the Program that can influence or reduce results. Katherine Rose is not responsible for your personal actions or choices before, during or after the Program. The Client understands that any use of any product, recipe, suggestion, or recommendation is at their own risk, with no liability on Katherine Rose’s part. The Client accept full responsibility for use, or non-use, of any information provided by Katherine Rose through any means whatsoever. The Client’s use, or non-use, of this information is at their own risk, and you absolve Katherine Rose of any liability or loss that may incur from their use or non-use of the information provided.

Client Stories: Katherine Rose may present real world experiences, examples, testimonials, photos, and insights about other people’s experiences for purposes of illustration only. They are not intended to represent or guarantee that current or future clients will achieve the same or similar results. Rather, these client stories represent what is possible with the program.. Each of these unique stories, and any and all results reported in these stories by past clients, are the culmination of numerous variables.
No Endorsement: Reference or links in the, Programs, to any other individual’s, business’s or entity’s information, opinions, advice, programs, products or services do not constitute my formal endorsement.
